1.   General

At Drill Dragon, we care about your personal information, so we have prepared this Privacy Policy to explain how we collect, use, and share it, as well as to inform you of your rights with regard to such information.

Drill Dragon maintains two distinct platforms, each designed for a different purpose, and we keep information separate between them, with different user accounts for each. 

The E-Commerce Site: DrillDragon.com serves as our online platform where you can learn about Drill Dragon products, stay informed on updates, and make purchases. It represents our primary client-facing presence.

The App: The Drill Dragon Training App is a mobile application that connects to proprietary electronic sensors, enabling users to perform drills and workouts, record training results, and maintain detailed statistics based on their training history.

To protect your privacy, we keep accounts for The E-Commerce Site and The App completely separate, each with its own login information. For example, a parent may purchase a product on The E-Commerce Site, while their child would use The App, without any sharing of personal information between the two platforms.

By using The E-Commerce Site or The App, you agree to Drill Dragon’s collection, use, and sharing of your personal information as described in this Privacy Policy.

2.   Information We Collect

When you use The E-Commerce Site, Drill Dragon may collect the following personal information about you:

·   Contact details including your name, address, phone number, and email.

·      Order information including your name, billing address, shipping address, payment confirmation, email address, and phone number.

· Account information including your username, password, security questions and other information used for account security purposes.

·     Customer support information including the information you choose to include in communications with us, for example, when sending a message via our website.

·    Information We Collect about Your Usage We may also automatically collect certain information about your interaction with The E-Commerce Site ("Usage Data"). To do this, we may use cookies, pixels and similar technologies ("Cookies"). Usage Data may include information about how you access and use our Site and your account, including device information, browser information, information about your network connection, your IP address and other information regarding your interaction with The E-Commerce Site.

·    Information We Obtain from Third Parties We may obtain information about you from third parties, including from vendors and service providers who may collect information on our behalf, such as:

o   Companies who support our Site and Services, such as Shopify.

o  Our payment processors, who collect payment information (e.g., bank account, credit or debit card information, billing address) process your payment in order to fulfill your orders and provide you with products or services you have requested.

o    When you visit The E-Commerce Site, interact with our Services, open our emails, or click on our advertisements, we and third parties (such as Google, Meta, and Shopify) may collect certain information through cookies, tracking pixels, and similar technologies. 

Some cookies are necessary for functionality (e.g., enabling checkout on Shopify), while others help us analyze site usage and serve relevant ads. Shopify, as our e-commerce provider, may place cookies necessary for functionality, analytics, and payment processing. We provide a cookie management tool that allows you to manage your preferences based on your location and applicable data privacy laws. Depending on your region, certain cookies may be enabled by default, require your consent before being set, or provide you with options to opt out.

When you use The App, Drill Dragon may collect the following personal information about you:

·     Contact details including your name, country, state or province you live in and your email address.

·        Date of Birth

·      Sport Training Data is a detailed record of your training and performance history and calculated statistics.

·  Activity Data we may collect data regarding what features of The App you use and how often you use them. 

3. How We Use Your Information

Personal Information collected when you use The E-Commerce Site is used to:

·      Provide Products and Services. We use your personal information to process your payments, fulfill your orders, to send notifications to you related to your account, purchases, returns, exchanges or other transactions, to create, maintain and otherwise manage your account, to arrange for shipping, facilitate any returns and exchanges and other features and functionalities related to your account.

·       Marketing and Advertising. We may use your personal information for marketing and promotional purposes, such as to send marketing, advertising and promotional communications by email, text message or postal mail, and to show you advertisements for products or services. This may include using your personal information to better tailor our services and advertising on The E-Commerce Site.  You can opt out of receiving marketing communications.

·       Security and Fraud Prevention. We use your personal information to detect, investigate or take action regarding possible fraudulent, illegal or malicious activity. If you choose to use The E-Commerce Site and register an account, you are responsible for keeping your account credentials safe. We highly recommend that you do not share your username, password, or other access details with anyone else. If you believe your account has been compromised, please contact us immediately.

·    Communicating with You and Service Improvement. We use your personal information to provide you with customer support and improve our services. This is in order to be responsive to you, to provide effective services to you, and to maintain our business relationship with you.

Personal Information collected when you use The App is used to:

·    Log Into The App and Identify Users. We use your email address to allow you to securely log into The App and along with your full name identify users.

·        Communicate With You. We use your email address to communicate with you for support and use of our service, as well as to provide notices and updates regarding our service and product offerings.

·  Maintain Your Sports Training Record. This is the primary purpose of The App, to keep a history of your sport training and performance over time. 

o   So you can see your sport specific training history and improvement in skills and performance over time.

o To calculate sports training and performance statistics by age group, so you can compare yourself to peers in the same age group.

o With your additional consent, to share training data with coaches and to allow coaches to share training regimens with you either individually or as a member of a team.   

·       Comply With Data Privacy Laws and Regulations.  We use the country, state or province of your residence and your date of birth to ensure we continually comply with applicable data privacy laws and regulations.

·  Service Providers But No Third Parties.  We use Service Providers who process data solely on our behalf, like Google Cloud Services.  These Service Providers do not use any of the data on their own behalf or for other commercial purposes.  We do not use any Third Parties that use personal information for their own benefit, such as marketing, research, or reselling the data.

 

4. How We Disclose Personal Information

In certain circumstances, we may disclose your personal information to other parties for contract fulfillment purposes, legitimate purposes and other reasons subject to this Privacy Policy. Such circumstances may include:

·   With vendors or other third parties who perform services on our behalf (e.g., IT management, payment processing, data analytics, customer support, cloud storage, fulfillment and shipping).

·      When you direct, request us or otherwise consent to our disclosure of certain information to third parties, such as to ship you products or through your use of social media widgets or login integrations, with your consent.

·       With our affiliates or otherwise within our corporate group, to effectively run our business.

·       In connection with a business transaction such as a merger or bankruptcy, to comply with any applicable legal obligations (including to respond to subpoenas, search warrants and similar requests), to enforce any applicable terms of service, and to protect or defend our services, our rights, and the rights of our users or others. 

5. Data Security and Data Retention

Please be aware that no security measures are perfect or impenetrable, and we cannot guarantee “perfect security.”  We endeavor to utilize Service Providers that are known to have robust data security infrastructure, including Shopify for The E-Commerce Site and Google Cloud for The App.  To help keep your account secure, be sure to use a strong and unique password and keep it private by not sharing it with others.

How long we retain your personal information depends on different factors, such as whether we need the information to maintain your account, to provide our services, comply with legal obligations, resolve disputes or enforce other applicable contracts and policies.

6. Third Party Websites

Both The E-Commerce Site and The App may provide links to websites or other online platforms operated by third parties. If you follow links to sites not affiliated or controlled by us, you should review their privacy and security policies and other terms and conditions.

We do not guarantee and are not responsible for the privacy or security of such sites, including the accuracy, completeness, or reliability of information found on these sites. Information you provide on public or semi-public venues, including information you share on third-party social networking platforms may also be viewable by other users of our services and/or users of those third-party platforms without limitation as to its use by us or by a third party.

7. Your Rights

You also have the following rights in relation to the personal information we hold about you, in addition to any other rights required by applicable law:

·         Know what personal information we have collected about you.

·        Access a copy of the personal information that we hold about you.

·        Request that we correct any inaccurate personal information about you.

·        Request that we delete any personal information we have collected from you.

 

8. Children’s Privacy

We know that children deserve extra privacy protection.  As with all users, we do not share or sell children’s personal information to Third Parties who would use such information for their own benefit. 

 The E-Commerce Site

The E-Commerce site is not intended to be used by children, and we do not knowingly collect any personal information about children.

 

The APP

The Drill Dragon Training App will have children among its users (meaning under the age of 13 for users in the United States) and we strictly comply with the Children's Online Privacy Protection Act (COPPA).

 

·        Prior to collecting personal information from a child, we obtain consent from the child’s parent or guardian through email verification. 

·       Only upon obtaining parental consent will we collect personal information from the child.

·       If we do not obtain verified parental consent the child will not be able to complete the registration process.

·        Parents have the right to:

o    Revoke their prior consent.

o    Review their child’s personal information.

o    Request their child’s personal information be corrected.

o    Request their child’s personal information be deleted.

 

9. Privacy Policy Updates

We may update our Privacy Policy to reflect changes to our information practices. We will notify You of any changes by posting the new Privacy Policy on this page and include the date the Privacy Policy was updated. 

 

If we make changes that are material, we will post a notice that we have made changes to this Privacy Policy on The E-Commerce Site for at least seven (7) days before the changes are made and indicate the date these terms were last revised.

 

As privacy laws and tracking technologies evolve, we may also update our cookie policies or tracking-related disclosures. If we begin selling in new regions, we will ensure compliance with the respective data protection laws. Updates will be reflected in this Privacy Policy.

 

We recommend that you review this Privacy Policy periodically for any changes.
